This legislation would add a new clause to the FWPCA that protects POTWs utilizing innovate or alternative technologies funded by a construction grant from civil penalty actions if the technology, despite due diligence, failed to meet design performance specifications during a period in which additional funding authorization is being sought, or design and construction are occurring pursuant to the Administrator's authorization of additional funding or modification.
