SUMMARY DESCRIPTION:
A bill to amend the Federal Water Pollution Control Act concerning the effect of administrative orders on civil penalty actions. This legislation would add a new clause to the FWPCA that protects POTWs utilizing innovate or alternative technologies funded by a construction grant from civil penalty actions if the technology, despite due diligence, failed to meet design performance specifications during a period in which additional funding authorization is being sought, or design and construction are occurring pursuant to the Administrator's authorization of additional funding or modification.

SUMMARY DESCRIPTION:
A bill to amend the Federal Water Pollution Control Act to control water pollution from concentrated animal feeding operations (CAFO), and for other purposes. The purposes of the legislation are to protect the public health, water quality and fisheries of the United States by establishing appropriate controls on water pollution from concentrated animal feeding lots. The bill proposes to permit CAFOs under Section 402 (National Pollutant Discharge Elimination System) of the Clean Water Act. Owners/operators of CAFOs meeting certain minimums for number of animals confined and duration of confinement would be required to have the operation permitted no later than 18 months and waste management plans for EPA approval no later than 2 years after the passage of the legislation. Permit violations would be subject to penalties under Section 309 (Federal Enforcement) of the Clean Water Act.

A bill to establish the Commission on Ocean Policy for the purposes of developing a National Ocean and Coastal Policy. The Commission would be provided 18 months after the enactment of this legislation to produce a report that provides recommendations for a national ocean and coastal policy. Following the release of the report, the President shall then develop and maintain a coordinated, comprehensive and long-range national policy with respect to ocean and coastal activities, including a plan to meet the infrastructure requirements of Federal ocean and coastal programs.

SUMMARY DESCRIPTION:
S.1213 directs the President to develop and maintain a coordinated, comprehensive, and long-range national policy, consistent with U.S. international obligations, on ocean and coastal activities. The legislation establishes the National Ocean Council to serve as the forum for developing national ocean policy and programs. The legislation also establishes the Commission on Ocean Policy to report to the President and Congress on a comprehensive national ocean and coastal policy to carry out the purpose and objectives of this Act.

S.1213 repeals the Marine Resources and Engineering Development Act of 1966.
